The criminal offense committed by Susilo as the Director of PT Unggul Puspa Negara was legally and convincingly proven guilty of committing the criminal act of transferring or renting out objects that were the object of fiduciary collateral without written approval from the financing company receiving the fiduciary.
Susilo was sentenced to 1 (one) year in prison and a fine of Rp. 20,000,000 (twenty million rupiah) and if the fine is not paid, it will be replaced by imprisonment for 3 (three) months, as in case number 718/Pid. Sus/2022/PT.PBR which was decided on January 19 2023 by the Panel of Judges at the Riau High Court.
This started when Susilo, the debtor of PT MNC Guna Usaha Indonesia, applied for financing for 3 units of heavy equipment from the Dossan Excavator brand to PT MNC Guna Usaha Indonesia, but Susilo did not make the installment payment to PT MNC Guna Usaha Indonesia.
Persuasive actions have been taken, starting from billing by telephone, to collection visits at home, however during the visit it was discovered that Susilo had transferred the object of the fiduciary guarantee without written approval from PT MNC Guna Usaha Indonesia. For his actions, Susilo was reported to Riau Regional Police Republic of Indonesia, in accordance with Law Number 42 of 1999 concerning Fiduciary Guarantees.
"We inform all debtors of PT MNC Guna Usaha Indonesia not to transfer, pawn or sell fiduciary collateral objects because in accordance with Law Number 42 of 1999 concerning Fiduciary Guarantees, these actions can be subject to criminal sanctions with a maximum prison sentence of 2 years and a fine of up to a lot of Rp. 50,000,000 (Fifty Million Rupiah)," said Fandy Gultom, S.H., C.L.A as Legal Counsel for PT MNC Guna Usaha Indonesia.
