The debtor of PT MNC Guna Usaha Indonesia Rendi Muhamad Apendi and Commissioner of PT Raja Trans Utama Niaga, was legally and convincingly proven guilty of committing a criminal act by transferring or renting out objects that were the object of fiduciary collateral without the written consent of the fiduciary recipient.
This embezzlement started with Rendi Muhamad Apendi as Commissioner of PT Raja Trans Utama Niaga together with Titin Supriatin as Director of PT Raja Trans Utama Niaga applying for financing for 1 (one) unit of Hino tronton and wingbox brand vehicle to PT MNC Guna Usaha Indonesia.
However, during the financing period, Rendi Muhamad Apendi as Commissioner of PT Raja Trans Utama Niaga together with Titin Supriatin as Director of PT Raja Trans Utama Niaga did not make installment payments to PT MNC Guna Usaha Indonesia.
PT MNC Guna Usaha Indonesia has carried out persuasive actions starting from billing via telephone calls, collection visits to the homes of Rendi Muhamad Apendi and Titin Supriatin as well as the PT Raja Trans Utama Niaga office, but at the time of the visit it was discovered that Rendi Muhamad Apendi as Commissioner of PT Raja Trans Utama has sold the fiduciary guaranteed object.
For this incident, the Panel of Judges at the Serang District Court sentenced Rendi Muhamad Apendi to 1 (one) year, 8 (eight) months in prison and a fine of Rp. 2,500,000 (two million five hundred thousand rupiah) and if the fine is not paid, it will be replaced by imprisonment for 1 (one) month, as in case number 876/Pid.B/2023/PN.Srg which was decided on January 3 2024.
"We urge all debtors of PT MNC Guna Usaha Indonesia not to transfer, pawn or sell fiduciary collateral objects because in accordance with Law Number 42 of 1999 concerning Fiduciary Guarantees, these actions can be subject to criminal sanctions with a maximum prison sentence of 2 years and a fine of up to a lot of Rp. 50,000,000 (fifty million rupiah)," said Fandy Gultom, S.H., C.L.A as Legal Counsel for PT MNC Guna Usaha Indonesia.
"PT MNC Guna Usaha Indonesia, which is a financing company, will firmly follow up on individuals who could harm the Company. "The important thing for us as a financing company is good communication with all debtors in Indonesia so that there are no detrimental things," said Yusnandi Liauw as Director of PT MNC Guna Usaha Indonesia, Friday (2/2/2024).
